Regulations on Open Government Information of the People's Republic of China

Scope of Application

Regulations for information disclosed by administrative agencies of the Chinese Government and the General Office of the State Council.

Purpose

Offers specific measures to ensure that the public can access government information.

Key Points on Stakeholder Engagement

The Chinese Government should: 

  • Disclose government information that fulfills the following criteria:
  • Involves the vital interests of local people and organizations.
  • Needs to be known by the public or allows their participation.
  • Shows the structure, function, and working procedures of each administrative agency.
  • Should be disclosed on each administrative agency’s own initiative according to Chinese laws, regulations, and provisions.

 

Examples of information for the National Government to disclose include, but are not limited to, the following:

  • Administrative regulations, rules, and regulatory documents.
  • Plans for national economic and social development, specific projects, and relevant policies.
  • Catalogs of the government’s procurement of projects, their standards, and their implementation.
  • Statistics of national economic and social development. 
  • Information about the approval and implementation of major construction projects.
  • Reports on financial budgets and final accounts.
  • Items subject to administrative fees and/or licensing, along with their legal bases, conditions, quantities, procedures, and deadlines.
  • Policies and measures on poverty assistance, education, medical care, social security, and job creation, as well as their implementation.
  • Emergency plans for, early warning information concerning, and countermeasures against sudden public events.

 

Examples of information for the District/City/County Government to disclose include, but are not limited to, the following:

  • Important and major matters in construction and management.
  • Information on the construction of social and public interest institutions.

Examples of information for the Town Government to disclose include but are not limited to the following:

  • Information about land requisition or appropriation, household demolition, and resettlement.
Key Points on Environmental and Social Impact Assessment

Administrative Agencies of the Chinese Government should: 

Disclose information about the supervision and inspection of environmental protection, public health, safe production, food and drugs, and product quality.
