Measures for the Administration of Foreign Aid (Trial)

Scope of Application

Regulations for the Ministry of Commerce (MOFCOM) and other agencies in the Chinese Government. Includes Chinese Government–funded foreign aid and activities that provide economic, technical, material, human resources, and administrative support to recipient countries.

Purpose

Offers basic measures to regulate and enhance the administration of foreign aid from China.

General Key Points

The Chinese Government should:

  • Ensure foreign aid respects host countries' national sovereignty and adheres to the principle of noninterference in internal affairs.
    • Focus on poverty, economic development, social development, and the environment. 

 

MOFCOM should:

  • Plan and implement foreign aid with assistance from Economic and Commercial Counselors' offices at Chinese Embassies and Consulates
  • Establish and maintain a foreign aid database.
  • Conduct feasibility studies before project implementation.
    • Decide whether projects meet necessary demands, unless decisions require approval from the State Council.
  • Inspect and supervise the safety, quality, functions, and progress of each project. 

 

MOFCOM may:

  • Suspend or revoke projects that are not feasible due to diplomatic relations, national security, or international obligations. 

 

Other Government Agencies in charge of aid projects should:

  • Adhere to MOFCOM’s regulations. 

 

Foreign Aid Workers should:

  • Abide by the host country’s laws and regulations.
