Scope of Application

Specific guidelines and principles for overseas activities implemented by private-owned enterprises (POEs).

Purpose

Offers detailed guidance to regulate, enhance, and promote the overseas investment and operation of POEs.

General Key Points

Developers and Contractors that are POEs should:

  • Abide by Chinese and host country laws and regulations, relevant treaty provisions, and other international practices.
  • Adhere to fair competition in overseas investment and operation.
  • Not bribe local public officials, officials of international organizations, and staff of affiliated companies.
  • Implement host countries' standards and regulations on project management.
  • Use international standards if host countries' laws and regulations are inadequate.

 

Developers and Contractors that are POEs must:

  • Apply for relevant permits for construction in accordance with host countries' environmental protection laws and regulations.

Developers and Contractors that are POEs should:

  • Embrace the principles of peaceful cooperation, openness, tolerance, mutual learning, and mutual benefits when engaging with relevant institutions and companies in host countries. 
  • Disclose information about social responsibilities and performance in a timely manner. 
  • Create job opportunities in project areas and hire local workers in accordance with host countries' laws and regulations.
  • Respect local culture, religion, and customs. 
  • Carry out cultural exchanges with host countries.
  • Strengthen communication and exchanges with local trade union organizations, the media, religious figures, ethnic leaders, civil society organizations (CSOs)/nongovernmental organizations (NGOs), and other sectors of society.
  • Actively support local public welfare in areas such as education, health, and community development.
Key Points on Environmental and Social Impact Assessment

Developers and Contractors that are POEs should:

  • Regularly issue social responsibility or sustainable development reports.
  • Evaluate proposed sites and conduct environmental impact assessments (EIAs) before construction begins.
