Provisions on Standardizing Competition in Foreign Investment and Cooperation

Scope of Application

Measures for developers and contractors operating overseas. Acts of unfair competition should be reported directly to the Ministry of Commerce (MOFCOM) with accurate, substantial, and relevant evidence.

Purpose

Offers basic measures to regulate overseas activities, including the management of social and environmental issues and the establishment of a "credit record" system.

General Key Points

MOFCOM should:

  • Establish a bad credit record system for overseas investment and cooperation. 
  • Record violations such as commercial bribery for market trading opportunities, exclusion of competitors through unfair price competition, collusive bidding, slander against competitors, false marketing, and other acts of unfair competition.
    • Notify the relevant authorities.
